Si vous n\u2019acceptez pas ces termes, n\u2019installez pas et n\u2019utilisez pas le Logiciel.<\/p>\n<p><\/p>\n<p data-start=\"1035\" data-end=\"1183\">Aucune disposition contenue dans vos bons de commande, demandes ou documents similaires n\u2019aura pour effet de modifier les termes du pr\u00e9sent CONTRAT.<\/p>\n<p><\/p>\n<hr data-start=\"1185\" data-end=\"1188\" \/>\n<h2 data-start=\"1190\" data-end=\"1217\"><strong data-start=\"1193\" data-end=\"1217\">CONDITIONS G\u00c9N\u00c9RALES<\/strong><\/h2>\n<p><\/p>\n<h3 data-start=\"1219\" data-end=\"1251\"><strong data-start=\"1223\" data-end=\"1251\">1. CONCESSION DE LICENCE<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"1253\" data-end=\"1536\">Sous r\u00e9serve des termes du pr\u00e9sent CONTRAT, LOBO BROTHERS TECHNOLOGY vous accorde une licence <strong data-start=\"1347\" data-end=\"1415\">limit\u00e9e, non exclusive, non sous-licenciable et non transf\u00e9rable<\/strong> pour installer et utiliser le Logiciel pendant la p\u00e9riode de validit\u00e9 indiqu\u00e9e dans votre abonnement ou contrat d\u2019achat.<\/p>\n<ul data-start=\"1538\" data-end=\"1826\">\n<li data-start=\"1538\" data-end=\"1715\">\n<p data-start=\"1540\" data-end=\"1715\">La licence permet l\u2019utilisation du Logiciel uniquement dans les environnements autoris\u00e9s et conform\u00e9ment aux sp\u00e9cifications techniques fournies par LOBO BROTHERS TECHNOLOGY.<\/p>\n<\/li>\n<li data-start=\"1716\" data-end=\"1826\">\n<p data-start=\"1718\" data-end=\"1826\">Le Logiciel peut contenir des composants propri\u00e9taires ou tiers soumis \u00e0 leurs propres licences respectives.<\/p>\n<\/li>\n<\/ul>\n<p><\/p>\n<h4 data-start=\"1828\" data-end=\"1882\"><strong data-start=\"1833\" data-end=\"1880\">A. Licence d\u2019\u00c9valuation (Essai de 30 jours)<\/strong><\/h4>\n<p><\/p>\n<p data-start=\"1883\" data-end=\"2167\">Si le Logiciel est fourni sous forme de Version d\u2019Essai, vous pouvez l\u2019utiliser <strong data-start=\"1963\" data-end=\"2009\">exclusivement pendant 30 jours calendaires<\/strong> \u00e0 compter de son activation, uniquement \u00e0 des fins internes d\u2019\u00e9valuation, de test ou de d\u00e9monstration, et <strong data-start=\"2116\" data-end=\"2164\">non en production ni \u00e0 des fins commerciales<\/strong>.<\/p>\n<p><\/p>\n<p data-start=\"2169\" data-end=\"2362\">\u00c0 l\u2019expiration de cette p\u00e9riode, le Logiciel peut cesser de fonctionner ou voir ses fonctionnalit\u00e9s r\u00e9duites. Vous devrez alors acqu\u00e9rir une licence commerciale pour poursuivre son utilisation.<\/p>\n<h4 data-start=\"2364\" data-end=\"2397\"><strong data-start=\"2369\" data-end=\"2395\">B. Licence Commerciale<\/strong><\/h4>\n<p><\/p>\n<p data-start=\"2398\" data-end=\"2570\">Apr\u00e8s l\u2019achat d\u2019une licence commerciale, vous pourrez utiliser le Logiciel conform\u00e9ment aux conditions contract\u00e9es, tant que votre abonnement ou contrat demeure en vigueur.<\/p>\n<p><\/p>\n<hr data-start=\"2572\" data-end=\"2575\" \/>\n<h3 data-start=\"2577\" data-end=\"2639\"><strong data-start=\"2581\" data-end=\"2639\">2. DROITS, LIMITATIONS ET OBLIGATIONS DE L\u2019UTILISATEUR<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"2641\" data-end=\"2717\">Sauf autorisation expresse dans le pr\u00e9sent CONTRAT, vous ne pouvez <strong data-start=\"2708\" data-end=\"2715\">pas<\/strong> :<\/p>\n<ul data-start=\"2719\" data-end=\"3284\">\n<li data-start=\"2719\" data-end=\"2841\">\n<p data-start=\"2721\" data-end=\"2841\">Modifier, traduire, d\u00e9compiler, d\u00e9sassembler, pratiquer l\u2019ing\u00e9nierie inverse ou cr\u00e9er des \u0153uvres d\u00e9riv\u00e9es du Logiciel.<\/p>\n<\/li>\n<li data-start=\"2842\" data-end=\"2943\">\n<p data-start=\"2844\" data-end=\"2943\">Supprimer ou alt\u00e9rer les mentions de droits d\u2019auteur, marques ou autres indications de propri\u00e9t\u00e9.<\/p>\n<\/li>\n<li data-start=\"2944\" data-end=\"3078\">\n<p data-start=\"2946\" data-end=\"3078\">C\u00e9der, sous-licencier, louer, vendre, pr\u00eater ou transf\u00e9rer de quelque mani\u00e8re que ce soit le Logiciel ou vos droits d\u2019utilisation.<\/p>\n<\/li>\n<li data-start=\"3079\" data-end=\"3189\">\n<p data-start=\"3081\" data-end=\"3189\">Utiliser le Logiciel \u00e0 des fins illicites, contraires \u00e0 l\u2019\u00e9thique ou portant atteinte aux droits de tiers.<\/p>\n<\/li>\n<li data-start=\"3190\" data-end=\"3284\">\n<p data-start=\"3192\" data-end=\"3284\">Utiliser le Logiciel d\u2019une mani\u00e8re compromettant sa s\u00e9curit\u00e9 ou celle de syst\u00e8mes connect\u00e9s.<\/p>\n<\/li>\n<\/ul>\n<p><\/p>\n<p data-start=\"3286\" data-end=\"3442\">Vous devez vous assurer que votre utilisation du Logiciel respecte la l\u00e9gislation applicable ainsi que les directives \u00e9tablies par LOBO BROTHERS TECHNOLOGY.<\/p>\n<p><\/p>\n<p data-start=\"3444\" data-end=\"3532\">Tous les droits non express\u00e9ment accord\u00e9s dans ce CONTRAT restent r\u00e9serv\u00e9s au Conc\u00e9dant.<\/p>\n<p><\/p>\n<hr data-start=\"3534\" data-end=\"3537\" \/>\n<h3 data-start=\"3539\" data-end=\"3574\"><strong data-start=\"3543\" data-end=\"3574\">3. PROPRI\u00c9T\u00c9 INTELLECTUELLE<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"3576\" data-end=\"3868\">Le Logiciel est la propri\u00e9t\u00e9 exclusive de <strong data-start=\"3618\" data-end=\"3651\">LOBO BROTHERS TECHNOLOGY S.L.<\/strong> et est prot\u00e9g\u00e9 par les lois nationales et internationales relatives \u00e0 la propri\u00e9t\u00e9 intellectuelle.<br data-start=\"3750\" data-end=\"3753\" \/>Ce CONTRAT ne vous accorde aucun droit de propri\u00e9t\u00e9 sur le Logiciel, mais uniquement un droit d\u2019utilisation limit\u00e9.<\/p>\n<p><\/p>\n<hr data-start=\"3870\" data-end=\"3873\" \/>\n<h3 data-start=\"3875\" data-end=\"3913\"><strong data-start=\"3879\" data-end=\"3913\">4. MISES \u00c0 JOUR ET MAINTENANCE<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"3915\" data-end=\"4275\">Les mises \u00e0 jour, am\u00e9liorations ou correctifs (\u00ab <strong data-start=\"3964\" data-end=\"3980\">Mises \u00e0 Jour<\/strong> \u00bb) fournis par LOBO BROTHERS TECHNOLOGY sont soumis aux termes du pr\u00e9sent CONTRAT, sauf indication contraire.<br data-start=\"4090\" data-end=\"4093\" \/>LOBO BROTHERS TECHNOLOGY n\u2019est pas tenue de fournir une assistance technique ou des mises \u00e0 jour continues, sauf si un plan de maintenance ou d\u2019abonnement sp\u00e9cifique a \u00e9t\u00e9 contract\u00e9.<\/p>\n<p><\/p>\n<hr data-start=\"4277\" data-end=\"4280\" \/>\n<h3 data-start=\"4282\" data-end=\"4307\"><strong data-start=\"4286\" data-end=\"4307\">5. LOGICIEL TIERS<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"4309\" data-end=\"4586\">Le Logiciel peut int\u00e9grer des composants ou services tiers (par exemple, services de messagerie), lesquels peuvent exiger l\u2019acceptation de leurs propres conditions.<br data-start=\"4473\" data-end=\"4476\" \/>LOBO BROTHERS TECHNOLOGY n\u2019est pas responsable de la performance ou de la disponibilit\u00e9 de ces services tiers.<\/p>\n<p><\/p>\n<hr data-start=\"4588\" data-end=\"4591\" \/>\n<h3 data-start=\"4593\" data-end=\"4623\"><strong data-start=\"4597\" data-end=\"4623\">6. ABSENCE DE GARANTIE<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"4625\" data-end=\"4996\">Le Logiciel est fourni <strong data-start=\"4648\" data-end=\"4665\">\u00ab en l\u2019\u00e9tat \u00bb<\/strong>, sans garantie de quelque nature que ce soit, expresse ou implicite, y compris mais sans s\u2019y limiter aux garanties de qualit\u00e9 marchande, d\u2019ad\u00e9quation \u00e0 un usage particulier ou d\u2019absence d\u2019erreurs.<br data-start=\"4862\" data-end=\"4865\" \/>LOBO BROTHERS TECHNOLOGY ne garantit pas que le Logiciel r\u00e9pondra \u00e0 vos attentes ni qu\u2019il fonctionnera sans interruption ni erreur.<\/p>\n<p><\/p>\n<hr data-start=\"4998\" data-end=\"5001\" \/>\n<h3 data-start=\"5003\" data-end=\"5042\"><strong data-start=\"5007\" data-end=\"5042\">7. LIMITATION DE RESPONSABILIT\u00c9<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"5044\" data-end=\"5359\">Dans la mesure maximale permise par la loi applicable, LOBO BROTHERS TECHNOLOGY ne pourra \u00eatre tenue responsable de dommages indirects, accessoires, sp\u00e9ciaux ou cons\u00e9cutifs (y compris pertes de b\u00e9n\u00e9fices, pertes de donn\u00e9es ou atteinte \u00e0 la r\u00e9putation), ni des co\u00fbts li\u00e9s \u00e0 la substitution de produits ou services.<\/p>\n<p><\/p>\n<p data-start=\"5361\" data-end=\"5578\">La responsabilit\u00e9 totale et cumul\u00e9e du Conc\u00e9dant pour toute r\u00e9clamation n\u2019exc\u00e9dera pas le montant effectivement pay\u00e9 pour la licence du Logiciel au cours des 12 mois pr\u00e9c\u00e9dant l\u2019\u00e9v\u00e9nement g\u00e9n\u00e9rateur de la r\u00e9clamation.<\/p>\n<p><\/p>\n<hr data-start=\"5580\" data-end=\"5583\" \/>\n<h3 data-start=\"5585\" data-end=\"5618\"><strong data-start=\"5589\" data-end=\"5618\">8. SAUVEGARDE DES DONN\u00c9ES<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"5620\" data-end=\"5921\">Vous \u00eates responsable d\u2019effectuer des copies de sauvegarde ad\u00e9quates avant l\u2019installation de Mises \u00e0 Jour ou la r\u00e9alisation de modifications.<br data-start=\"5761\" data-end=\"5764\" \/>LOBO BROTHERS TECHNOLOGY ne saurait \u00eatre tenue responsable de pertes de donn\u00e9es r\u00e9sultant d\u2019une mauvaise utilisation ou de d\u00e9faillances hors de son contr\u00f4le.<\/p>\n<p><\/p>\n<hr data-start=\"5923\" data-end=\"5926\" \/>\n<h3 data-start=\"5928\" data-end=\"5959\"><strong data-start=\"5932\" data-end=\"5959\">9. DUR\u00c9E ET R\u00c9SILIATION<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"5961\" data-end=\"6208\">Le pr\u00e9sent CONTRAT prend effet lors de l\u2019installation ou de l\u2019activation du Logiciel et reste valide tant que votre licence est active.<br data-start=\"6096\" data-end=\"6099\" \/>LOBO BROTHERS TECHNOLOGY peut r\u00e9silier imm\u00e9diatement le pr\u00e9sent CONTRAT en cas de violation de ses clauses.<\/p>\n<p><\/p>\n<p data-start=\"6210\" data-end=\"6333\">En cas de r\u00e9siliation, vous devrez cesser toute utilisation du Logiciel et supprimer toutes les copies en votre possession.<\/p>\n<p><\/p>\n<hr data-start=\"6335\" data-end=\"6338\" \/>\n<h3 data-start=\"6340\" data-end=\"6374\"><strong data-start=\"6344\" data-end=\"6374\">10. PROTECTION DES DONN\u00c9ES<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"6376\" data-end=\"6802\">LOBO BROTHERS TECHNOLOGY respectera la l\u00e9gislation applicable en mati\u00e8re de protection des donn\u00e9es personnelles (R\u00e8glement (UE) 2016\/679 \u2013 RGPD et loi organique espagnole 3\/2018).<br data-start=\"6555\" data-end=\"6558\" \/>Le Logiciel ne collecte pas de donn\u00e9es personnelles autres que celles strictement n\u00e9cessaires \u00e0 son fonctionnement.<br data-start=\"6673\" data-end=\"6676\" \/>Pour plus d\u2019informations, veuillez consulter la <strong data-start=\"6724\" data-end=\"6756\">Politique de Confidentialit\u00e9<\/strong> disponible sur le site officiel de LoboGuard.<\/p>\n<p><\/p>\n<hr data-start=\"6804\" data-end=\"6807\" \/>\n<h3 data-start=\"6809\" data-end=\"6862\"><strong data-start=\"6813\" data-end=\"6862\">11. EXPORTATION ET UTILISATION INTERNATIONALE<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"6864\" data-end=\"7061\">Vous vous engagez \u00e0 ne pas exporter ou transf\u00e9rer le Logiciel vers des pays ou territoires soumis \u00e0 des restrictions ou embargos internationaux selon les lois de l\u2019Union Europ\u00e9enne et de l\u2019Espagne.<\/p>\n<p><\/p>\n<hr data-start=\"7063\" data-end=\"7066\" \/>\n<h3 data-start=\"7068\" data-end=\"7105\"><strong data-start=\"7072\" data-end=\"7105\">12. CESSION ET SOUS-TRAITANCE<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"7107\" data-end=\"7356\">Vous ne pouvez c\u00e9der ni transf\u00e9rer vos droits ou obligations au titre du pr\u00e9sent CONTRAT sans l\u2019accord pr\u00e9alable \u00e9crit de LOBO BROTHERS TECHNOLOGY.<br data-start=\"7254\" data-end=\"7257\" \/>Le Conc\u00e9dant peut sous-traiter des services ou c\u00e9der ses droits sans n\u00e9cessiter votre consentement.<\/p>\n<p><\/p>\n<hr data-start=\"7358\" data-end=\"7361\" \/>\n<h3 data-start=\"7363\" data-end=\"7399\"><strong data-start=\"7367\" data-end=\"7399\">13. MODIFICATIONS DU CONTRAT<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"7401\" data-end=\"7623\">LOBO BROTHERS TECHNOLOGY peut mettre \u00e0 jour ou modifier ce CONTRAT en publiant sa version en vigueur sur son site officiel. Cette version remplacera toutes les versions pr\u00e9c\u00e9dentes et entrera en vigueur d\u00e8s sa publication.<\/p>\n<p><\/p>\n<hr data-start=\"7625\" data-end=\"7628\" \/>\n<h3 data-start=\"7630\" data-end=\"7671\"><strong data-start=\"7634\" data-end=\"7671\">14. LOI APPLICABLE ET JURIDICTION<\/strong><\/h3>\n<p><\/p>\n<p data-start=\"7673\" data-end=\"7948\">Le pr\u00e9sent CONTRAT est r\u00e9gi par les lois de <strong data-start=\"7717\" data-end=\"7730\">l\u2019Espagne<\/strong>.<br data-start=\"7731\" data-end=\"7734\" \/>Pour tout litige d\u00e9coulant du pr\u00e9sent CONTRAT, les parties se soumettent express\u00e9ment \u00e0 la <strong data-start=\"7825\" data-end=\"7884\">juridiction exclusive des Tribunaux de Madrid (Espagne)<\/strong>, renon\u00e7ant \u00e0 toute autre juridiction \u00e9ventuellement applicable.<\/p>\n<p><\/p>\n<hr data-start=\"7950\" data-end=\"7953\" \/>\n<h3 data-start=\"7955\" data-end=\"7974\"><strong data-start=\"7959\" data-end=\"7974\">15.
